大阪府泉佐野市が、ふるさと納税の新制度から同市を除外した総務省の決定取り消しを求めた訴訟で、国勝訴とした大阪高裁判決を不服として最高裁に上告した市は２５日「市の排除は恣意的な措置で、独立した地方自治体の地位を侵害する憲法違反だ」とする上告理由書を同高裁に提出した。
