《視点》ふるさと納税訴訟判決 地方自治の指針みえず
大阪高裁が判決を言い渡したふるさと納税をめぐる訴訟は、自治体と国が法廷で争う最初の事例で、分権改革が進められてきた地方自治のあり方も問われた。判決は国側の主張を全面的に認めたが、地方自治に新しい指針を示したとはいいがたい。
